Self-Employed Writer, Artist or Composer

This is a highly advantageous category for self-employed persons coming within the definition of writer, artist or composer to carry on their profession in the United Kingdom.

How do I qualify for this type of permit?

  • You must have established yourself outside the UK as a writer, artist or composer primarily engaged in producing original work which has been published (other than exclusively in newspapers or magazines), performed or exhibited for its literary, musical or artistic merit.
  • You must not intend to work except as related to your self-employment as a writer, artist or composer.
  • You have for the preceding year been able to maintain and accommodate yourself and any dependents from your own resources without working except as a writer, artist or composer.

Do I need entry-clearance?

You will need to apply for entry-clearance from the British High Commission before you travel to the United Kingdom. You will have to satisfy the entry-clearance officer in your home country that you fulfil the above criteria. As this can be a very complicated category, it is essential to get help from Breytenbachs.

Some rules and restrictions on a writer, artist or composer:

  • You cannot take employment in the United Kingdom under this category.
  • You do not need to invest any minimum capital in the United Kingdom, simply to show that you will be able to survive from your activities without recourse to public funds.
  • You are entitled to bring your dependents to the UK, and they will be free to work without restriction.
  • You will be initially allowed to remain for 12 months, after which you will have to apply to extend your stay.

Does this visa lead to indefinite leave to remain?

Yes, if you obtain permission to stay in the UK on this basis for 5 years as a writer, artist or composer, you can apply at the end of this period for ILR.
